You spent months on it. Late nights in the garage, a workbench covered in failed prototypes, a credit card with a suspiciously large Digi-Key charge. And now you've got something real — a product that works, that people want, that could actually go somewhere.

Then someone asks: "Have you patented it yet?"

Cue the panic.

Intellectual property law has a reputation for being expensive, slow, and completely inaccessible to anyone who isn't already running a funded startup. And honestly? That reputation isn't entirely wrong. Full utility patent prosecution can run $10,000 to $20,000 or more by the time you factor in attorney fees, USPTO filing costs, and the long wait for approval.

But here's what most makers don't realize: the all-or-nothing framing is a myth. There's a whole spectrum of IP tools available to you — some cheap, some free, some surprisingly strategic — and knowing when to use which one can be the difference between protecting your work and wasting money you don't have.

Let's break it down.

Start With the $320 Move: The Provisional Patent

If you're early-stage and not sure whether your product will find a market, a provisional patent application is almost always your best first step. It costs $320 for micro-entities (which most individual makers qualify as) directly through the USPTO, and it buys you 12 months of "patent pending" status.

That's a full year to test your idea, pitch to retailers, launch a crowdfunding campaign, or talk to manufacturers — all while having documented legal priority over your invention. If someone tries to copy you in that window, your provisional filing date is your timestamp.

The provisional doesn't have to be a polished legal document. It needs to describe your invention clearly and thoroughly — drawings, diagrams, technical specs, how it works, what makes it different. Many makers write their own using the USPTO's official guidelines and resources from sites like Google Patents to see how similar inventions are described.

Just remember: after 12 months, you either convert it to a full utility patent or it expires. That's the clock you're working against.

Design Patents: The Underrated Tool

Utility patents protect how something works. Design patents protect how something looks. And for a lot of consumer products — especially things where the aesthetic is part of the value — a design patent is both cheaper and faster to get.

Filing fees for a design patent run around $220 for micro-entities. They typically get approved in 12 to 18 months, compared to the multi-year slog of a utility patent. And they're enforceable — Apple famously won over a billion dollars in a design patent case against Samsung.

If your product has a distinctive shape, interface, or visual identity that competitors might copy, a design patent deserves serious consideration. It won't stop someone from building a product that functions the same way, but it will stop them from making something that looks like yours.

Trademarks: Protecting Your Brand, Not Just Your Blueprint

Here's something a lot of first-time makers miss: your product's brand can be just as valuable as the product itself. A registered trademark protects your name, logo, and brand identity from being copied or confused with competitors — and it lasts as long as you keep using it and paying renewal fees.

Trademark registration through the USPTO runs about $250 to $350 per class of goods, depending on the filing basis. You can search existing marks for free using the USPTO's TESS database before you file, which is worth doing early — finding out your product name is already trademarked after you've built a following is a painful lesson.

For makers who are building a brand around their workshop, their Etsy shop, or a line of products, a trademark is often more immediately useful than a patent. It protects the trust and recognition you've built with your audience.

The Open-Source Option: When Sharing Is the Strategy

Not every maker wants or needs proprietary protection — and that's not a failure of ambition. It's sometimes the smartest move in the room.

Open-source licensing, particularly frameworks like Creative Commons or the CERN Open Hardware License, lets you share your designs freely while still maintaining attribution rights and controlling how others can use or commercialize your work. The CC BY-NC-SA license, for example, lets people remix and build on your design for non-commercial purposes, as long as they credit you and share alike.

When You Actually Need a Lawyer

Look — this guide is about doing more yourself, but let's be real about the limits. There are situations where DIY IP strategy genuinely isn't enough:

The good news: you don't have to start there. Many IP attorneys offer free initial consultations. Law school clinics — including programs at places like the University of New Hampshire Franklin Pierce School of Law and several state-funded inventor assistance programs — offer low-cost or sliding-scale help to independent inventors.

The USPTO also runs a Patent Pro Bono Program that matches qualifying inventors with volunteer attorneys at no charge. If you meet the income requirements, it's worth applying.

Build a Paper Trail From Day One

Regardless of which formal protections you pursue, one habit every maker should develop immediately: document everything. Dated lab notebooks, timestamped photos, version-controlled design files, email threads with collaborators. If you ever need to prove when you invented something or who came up with what, your documentation is your evidence.

Git repositories with public commit histories are surprisingly useful here — they create an immutable, timestamped record of your development process. Some makers use notary services for key milestones. Others simply email themselves photos of prototypes with detailed descriptions, creating a dated record in their inbox.

It's not glamorous. But it's the foundation everything else sits on.

The Bottom Line

IP strategy doesn't have to be an all-or-nothing bet. A provisional patent buys you time. A design patent protects your look. A trademark guards your brand. Open-source licensing can build an audience faster than exclusivity ever could. And smart documentation costs nothing but a little discipline.

The makers who navigate this best aren't the ones with the biggest legal budgets — they're the ones who understand what they actually need to protect and why. Figure that out first, then pick your tools accordingly.

Your invention is worth protecting. You don't have to go broke doing it.
